CANCELATION OF ELECTION OF DIRECTORS

Dear Mill Creek Home Owners Association:

Following the Deadline of April 29th, 2026 for nominations, Business Connections, as the Inspector of Elections has reported receiving 2 nominations. Because there were two positions and two nominations received, there will be no ballots mailed out this year due to Uncontested Election of Directors.

The proposed election and meeting of July 24th, 2026 for tabulating the ballots have been canceled.

Bellow is Section 6.3 and 5115(a) of the By Laws which allows:

6.3 Uncontested Election of Directors. If after the close of nominations, the number of Members nominated for the Board is equal to or less than the number of Directors to be elected, as provided for in Civil Code Section 5115(a) and the number of qualified candidates is not more than the number of vacancies to be elected, as determined by the inspector of elections, the Association acting through the Board may, but is not required to, consider the qualified candidates elected by acclamation if all of the conditions in Civil Code Section 5103 have been met.

5115(a) if after the close of nominations, the number of Members nominated for the Board is equal to or less than the number of Directors to be elected and the number of qualified candidates is not more than the number of vacancies to be elected, as determined by the inspector of elections, the Association acting through the Board has considered the qualified candidates elected by acclamation.
